    　　诸葛亮飙英文、唐僧反内耗…… 　　AI“二创魔改”的边界在哪？ 　　诸葛亮飙起了流利的英文 　　不知道大家有没有刷到过这样的视频？明明是经典影视剧的名场面，却被一些创作者把台词通过AI技术进行了二次改造：舌战群儒的诸葛亮飙起了流利的英文、一心向佛的唐僧大谈如何反内耗等。视频中，人物口型严丝合缝，精准对齐，看不出一点“违和感”。 　　AI“魔改”制作门槛低 　　“只要给我30秒没有处理过的声音，我能立刻让指定的人开口说话。”记者在多个短视频平台输入“AI配音、魔改”等关键词，算法会立即推送一连串反差强烈的画面。 　　一些短视频平台上还有不少博主发布教程，教大家如何利用AI制作“魔改”视频。不少博主表示，使用AI工具配音没有太高的技术门槛，“人人可上手”。 　　记者梳理后发现，AI配音在日常生活中多用于以下场景：首先是文字转语音，通过上传一段编辑好的文字，经过软件技术处理，变成想要的声音呈现。其次是将原始语音通过AI变声，用在社交平台博主分享生活的视频中。他们为了保护自己的原始声纹，选择这样的替代方式。 　　北京一家移动互联网商业智能服务公司的负责人张万子说，克隆声音，只需一个人十秒的讲话，软件就可以把此人声音的频率、节奏数字化，通过大模型进行加工学习，最后把声音克隆到声音库里后，就可以输入文案，生成音频。 　　角色克隆，需要有较清晰的面部影像视频片段，直接提交到AI大模型里，它就会识别并分析面部整个点位。比如有些视频里的唐僧画面，嘴型有些模糊，其实就是“换嘴”了，用已有的口型又派生出几十种口型再贴回来。 　　实际上，低门槛是AI“魔改”类视频爆火的导火索。过去，一段二创配音至少需要剪辑、混音、压轴、对轨等半专业操作；如今，上传原始音频到在线语音模型，勾选“情绪风格”，再输入文本，几分钟即可生成足以以假乱真的明星声线。 　　去年，北京互联网法院曾对全国首例“AI声音侵权案”进行一审宣判，认定作为配音师的原告，其声音权益及于案涉AI声音，被告方使用原告声音、开发案涉AI文本转语音产品未获得合法授权，构成侵权，判令被告书面赔礼道歉，并赔偿原告各项损失25万元。 　　是否违法需多场景中判断 　　华东政法大学传播法研究中心副教授袁锋表示，影视剧属于视听作品，受《中华人民共和国著作权法》保护。利用一些经典影视剧的画面配声音，究竟是合理使用还是违法行为，要放到实际使用场景中判断。 　　袁锋介绍，著作权法第四条也给权利人规定了17项专有权利，其中有一条叫改编权，他人如果利用视听作品画面，需经过著作权人许可。但同时，著作权法第二十四条也给权利人规定了合理使用的条款，如果符合其中的情形可以构成合理使用。 　　就一些短视频而言，大多数情况都属于娱乐性的目的，这种情况构成合理使用的可能性比较小。 　　(扬子晚报) 【编辑:张令旗】|dfg|
