    　　中新社香港12月21日电 题：黎智英案审判公开公平公正 外部势力攻击抹黑不攻自破 　　中新社记者 香卢平 　　香港特区高等法院原讼法庭12月15日裁决黎智英两项串谋勾结外国势力罪及一项串谋发布煽动刊物罪成立后，香港社会各界同声支持。然而，一些外部势力罔顾事实，攻击抹黑正义审判，企图借“新闻自由”为黎智英洗白，甚至散布黎智英遭受人身虐待的失实言论，经不起事实和法律的检验。 　　实际上，特区高等法院原讼法庭对黎智英案进行了多达156日的公开聆讯，审视了2220项证物、逾8万页文件，14名控方证人的证词，黎智英本人更出庭作供多达52天。法庭就该案作出的裁决理由长达855页，完全公开供公众查阅。裁决理由清楚表明，黎智英并非因其政治观点或信念受审。检方指控的关键是他勾结外国势力危害国家安全。 　　香港法律界普遍认为，黎智英案审判公开、公平、公正。香港大律师公会声明指出，黎智英案以公开聆讯形式进行，过程完全透明。香港律师会声明强调，审讯过程中，各方均有法律代表，未有任何一方的法律代表提出曾受不公平待遇。两大法律专业团体均呼吁公众详细阅读裁决理由，尊重香港司法程序。 　　值得注意的是，法庭同时裁定，黎智英有意识地利用《苹果日报》及其个人影响力进行持续不断的活动，以达致下述目的：削弱中央政府、香港特区政府及其机构的合法性或权威；损害中央政府和香港特区政府与香港居民的关系。这些行为“已远超出法律所允许的范围”。 12月15日上午，反中乱港分子黎智英与苹果日报3家公司涉嫌违反香港国安法等案件在香港开庭。香港特区高等法院原讼法庭当日就案件作出裁决，黎智英两项串谋勾结外国势力罪及一项串谋发布煽动刊物罪成立。图为当日裁决后，黎智英由惩教署车辆押送离开。　中新社记者 李志华 摄 　　全国政协港澳台侨委员会副主任、香港新时代发展智库主席屠海鸣接受中新社记者采访时指出，法庭裁决黎智英罪名成立，厘清了违法与新闻自由的边界。根据《公民权利和政治权利国际公约》第十九条，《欧洲人权公约》以及相关判例确立的原则，新闻从业人员在发布言论、信息和文章时，必须遵守和履行“特别责任和义务”，包括保障国家安全和公共秩序。黎智英案昭示人们，新闻从业人员和其他人一样，都有义务遵守所有法律。 　　针对黎智英遭受人身虐待的失实言论，特区政府发言人明确指出，黎智英的各项合法权利都得到有效保障。在今年8月的公开法庭聆讯中，黎智英的代表律师已向法庭确认，惩教院所为黎智英每日安排医疗检查，且对黎智英在惩教院所内获得的医疗服务没有任何投诉，法官表示惩教署值得称赞。惩教署亦按黎智英的意愿，安排专职教士提供宗教服务。 　　法庭15日裁决当天，旁听人士清楚看到，黎智英行走正常，无需他人搀扶，更主动向旁听席的亲友点头挥手，健康状态良好，与个别媒体渲染所谓“身体虚弱”“遭受虐待”的说法明显不符。黎智英代表律师退庭后坦言：“大家在庭上见到他精神，我没有补充。” 　　“外部势力的施压干预与蓄意抹黑，改变不了香港特区司法机构对黎智英案依法独立审判的事实，更无法撼动香港由治及兴的光明发展前景。”港区全国人大代表、香港律师黄英豪认为，当前，香港维护国家安全的法律制度和执行机制愈加健全；在高水平安全保障下，香港社会繁荣稳定、经济稳步增长，这是对一切外部政治操弄最有力、最彻底的回应。(完) 【编辑:苏亦瑜】|dfg|
