    公安机关成功侦破一起美方通报的涉嫌“洗钱”案

    　　日前，辽宁省沈阳市公安局成功侦破“佟某某等人非法经营案”。 　　2024年4月，一条美方通报的中国籍人员佟某某涉嫌为毒贩洗钱线索，引起了我国警方高度重视。为查明真相，公安部立即部署辽宁省公安厅开展核实工作。 　　经前期侦查，辽宁省公安厅依法以涉嫌非法经营(外汇)犯罪立案，并将案件移交给佟某某等人户籍所在地沈阳市公安机关依法继续侦办。 　　围绕佟某某等人犯罪线索，沈阳警方成立工作专班，克服线索碎片化、境外调查取证不便、中美法律体系差异等困难，开展多维度缜密侦查，迅速固定了重要证据。 　　2024年5月20日，沈阳警方在湖北武汉将企图潜逃出境的佟某某、陈某某当场抓获。 　　案件侦办过程中，沈阳警方先后派出25个取证小组，前往16个省、43个市对佟某某、陈某某实施非法买卖外汇等行为开展落地核查。 　　2000余名涉案人员、数百家公司的4.9万个账户1056万条交易记录……面对如此庞大复杂的数据，工作专班抽丝剥茧，不断完善证据链条，最终全面查清佟某某、陈某某等人非法买卖外汇等犯罪事实。 　　经查，2017年以来，佟某某等人在美国开设车行销售汽车并为购车客户提供人民币和美元兑换服务，后期转为专门从事非法买卖外汇等犯罪活动。 　　2020年1月至2021年6月期间，佟某某在美国主要采取“对敲”方式，指使居住在中国境内的陈某某等人，利用在国内办理的多张银行卡，接收换汇转账。资金到账后，佟某某在美国向换汇人或其亲属支付美元现金，收取1%—2%手续费。经审计，佟某某通过境内银行卡实施非法买卖外汇金额合计1600余万元人民币。 　　佟某某承认，其在美国经营车行期间，结识了墨西哥商人JC。JC获知佟某某因给他人换汇需要美元现金，提出以美元现金向其购买虚拟货币。于是，佟某某指使陈某某通过多种渠道购买比特币、泰达币等虚拟货币后，卖给JC换取美元现金。 　　据佟某某供述，为JC换汇只占其业务一部分。佟某某在美期间，主要为有大额换汇需求的留学生、商人，以及美国当地的一些赌客提供换汇服务。 　　警方介绍，据佟某某交代，其虽在美国从事换汇活动，但并不知晓JC等人提供的资金具体来源，各方掌握的现有证据不能确认佟某某明确知道上游资金性质。侦查工作中，警方同时发现一些不法分子在大额现金存取、虚拟货币交易等方面规避美方监管，目前，已通过中美反洗钱合作沟通渠道反馈美方，并就在反洗钱领域加强执法合作达成共识。 　　2024年11月26日，公安机关将此案移送检察机关审查起诉。2025年9月，沈阳市皇姑区人民法院经审理认为，被告人佟某某、陈某某违反国家有关法律规定，非法买卖外汇，扰乱金融市场秩序，情节严重，以非法经营罪分别判处佟某某、陈某某有期徒刑一年七个月、一年四个月，并处罚金。 　　警方提醒：广大群众应选择银行等正规渠道兑换外汇；同时，留学生等出境人员切勿将个人银行账户、网络支付账户等出借他人，谨防被不法分子利用。 　　记者 张天培 　　《人民日报》(2025年12月20日 第 04 版) 【编辑:张子怡】|dfg|
