    生态环境法典草案三审 紧急情况下造成野生动物损害不担责

    　　中新社北京12月22日电 (记者 谢雁冰 郭超凯)生态环境法典草案三次审议稿22日提请十四届全国人大常委会第十九次会议审议。其中增加规定，在野生动物危及人身安全的紧急情况下，采取措施造成野生动物损害的，依法不承担法律责任。 　　生态环境法典是中国第二部以“法典”命名的法律。2025年4月，生态环境法典草案整体亮相，初次提请审议的草案共分5编，包括总则编、污染防治编、生态保护编、绿色低碳发展编、法律责任和附则编。今年9月和10月，生态环境法典各编草案分拆为两批完成了二审。按照工作安排，将分拆审议并修改完善的各编草案重新“合体”提请三次审议。 　　在总则编，增加“弘扬生态文化”的内容，同时进一步总结和体现司法实践成果，对人民法院、人民检察院在生态环境保护工作中的职能作进一步补充完善。 　　在污染防治编，完善秸秆、落叶等焚烧的组织和管理相关规定，对固体废物跨省转移增加相关监管规定。 　　在生态保护编增加规定，国家支持开展海洋生态保护、深海极地考察、防沙治沙等方面的国际交流与合作；国家积极参与国家管辖范围以外区域的海洋生物多样性养护和可持续利用。 　　近年来，食草野生动物与家畜争草场、大型野生动物伤人等问题多发，草案三审稿加强规范引导。其中增加规定，在野生动物致害严重区域，县级以上地方人民政府应当组织有关单位和个人积极开展野生动物致害综合防控，科学预防野生动物可能造成的危害；在野生动物危及人身安全的紧急情况下，采取措施造成野生动物损害的，依法不承担法律责任。 　　在绿色低碳发展编，进一步充实绿色低碳发展的总体要求，聚焦绿色低碳循环经济体系建设，强化资源回收利用有关制度措施，并进一步体现坚持“双碳”引领，完善应对气候变化有关制度和要求。 　　草案三审稿还进一步补充相关法律责任，并完善有关处罚措施。(完) 【编辑:惠小东】|dfg|
