    我国拟制定基础性综合性国有资产法

    　　中新网北京12月22日电 (记者 郭超凯 曾玥)国有资产法草案22日提请十四届全国人大常委会首次审议。据介绍，制定基础性、综合性的国有资产法，完善国有资产法律制度体系，对于在法治轨道上提升国有资产治理效能意义重大。 　　草案共7章62条，包括总则、国有资产所有权人职责、国有资产管理、国有资产报告、国有资产监督、法律责任、附则。 　　草案对国有资产的定义和分类作出规定。根据草案，国有资产是依照宪法、法律规定明确为国家所有，或者国家通过购买、出资、征收、接受捐赠等方式取得或形成的境内外财产和权益。国有资产分为国有自然资源资产、行政事业性国有资产、企业国有资产以及其他国有资产。 　　草案专章规定国有资产管理，在梳理各类国有资产共同适用的管理规定的基础上，聚焦国有资产全生命周期中与履行所有权人职责密切相关的关键环节，对政府、部门机构和直接支配使用国有资产的国家机关和事业单位、国家出资企业均明确有关具体管理要求。例如，草案对国有资本参股权益管理、行业协会商会资产管理和监督、维护国有资产安全和国家安全等作出规定，明确“未经法定程序批准，不得擅自配置、使用、处置国有资产”等禁止性规定，防止国有资产流失。 　　草案规定了国有资产报告和监督相关制度。针对国有资产管理情况报告基础数据有待夯实、质量有待提高等问题，草案将报告的职责要求延伸覆盖到履行所有权人职责的全部管理环节，压实履职主体和直接支配使用主体的报告责任，进一步强化国有资产全口径报告、全方位监督。 　　草案还明确规定国有资产领域人大、政府、监察、审计、财会等各类监督职责，推动构建贯通协调的国有资产监督体系，增强监督的刚性和实效。(完） 【编辑:周驰】|dfg|
