    　　近年来，“主理人”这个自带“自由”“创意”光环的头衔，在新业态的浪潮中迅速“破圈”，成了新潮职业的代名词。然而，都叫“主理人”，有人手握品牌所有权，是创业老板；有人实则干着销售、运营的工作；还有人被企业以“主理人”名义招募，却面临劳动权益受损的情况。专家表示，“主理人”并非法律概念，其身份界定的关键要看实际的权利义务关系。(见12月11日《工人日报》) 　　“主理人”一词原本承载着创意、自主与品牌人格化的内涵，是新消费与个性化表达的产物。然而，当其从时尚、设计等小众领域“破圈”，泛滥于各类招聘描述时，词义便被稀释甚至扭曲。如今，从品牌创始人、创业合伙人到承担具体销售、运营任务的受雇员工，皆可冠以此名。称呼的泛化一定程度上折射出新业态的活力，但也埋下了法律身份混淆的隐患——华丽名号之下，劳动关系是否清晰、劳动者权益是否得到保障？ 　　一些企业在招聘时使用“主理人”等话语，本质上是一种用工策略，将传统岗位进行“魅力化包装”，试图使劳动者自愿接受更弹性、更不确定的工作条件与报酬方式，实现模糊雇佣关系本质的目的。当“主理人协议”替代劳动合同、“业绩分成”取代工资与社保，“合作伙伴”的身份便可能代替劳动合同中的“劳动者”，留下用工风险与权益真空。 　　穿透“主理人”头衔的迷雾，审视真实的权利义务关系，对劳动者至关重要。法律上的身份判定，关键不看头衔而看实质：是否接受用人单位的管理、指挥与监督？工作是否构成其业务组成部分？报酬是否具有劳动对价特性？如存在明确考勤考核、接受管理、服从安排等有酬劳动，均构成劳动关系。相关司法案例已明确，一些“醉翁之意不在酒”的“主理人协议”并不能规避劳动关系、逃避法定义务。 　　新职业蓬勃发展是社会进步的体现，但必须以清晰的权责界定和坚实的权益保障为基石。劳动者需增强权利意识，在应聘时仔细甄别岗位实质，明确约定工作内容、考核标准与薪酬结构，并注意保存劳动合同、考勤记录、工作成果等关键证据。有关部门应加强对新职业用工的调研与规范，及时发布指引、案例，打击以创新为名行侵权之实的行为。招聘平台也需对岗位描述的规范性与真实性承担起审核责任。 　　“主理人”现象是观察当下劳动力市场演变的一个窗口。这提醒我们，在鼓励灵活就业与创业精神的同时，必须不断筑牢劳动者权益保护防线。职业称谓可以千变万化，但劳动尊严与法定权利义务不应因话语包装而消解。唯有确保名副其实、权责对等，这些充满想象力的新角色，才能真正成为释放创造力的新机会。这是维护社会公平正义的必然要求，也是新职业行稳致远的前提。(王志高) 　　《工人日报》(2025年12月16日 05版) 【编辑:陈海峰】|dfg|
